Federal Contractor Requirements – COVID-19

On September 9, 2021, President Biden issued Executive Order 14042, Ensuring Adequate COVID Safety Protocols for Federal Contractors. The Executive Order requires Federal contractors and subcontractors to ensure their covered workforce is vaccinated for COVID-19, except in limited circumstances provided for by law, by December 8, 2021. The Safer Federal Workforce Task Force issued implementing guidance to support Executive Order 14042 on September 24, 2021. The Task Force guidance can be accessed here.

U.S. EPA – Regulation of Persistent, Bioaccumulative, and Toxic Chemicals

Earlier this year, the U.S. Environmental Protection Agency issued a rule to regulate five persistent, bioaccumulative, and toxic (PBT) chemicals. One of those chemicals, phenol, isopropylated phosphate 3:1 (PIP (3:1)), has multiple uses throughout the economy. PIP (3:1) is used as a plasticizer, flame retardant, an anti-wear additive in hydraulic fluid, lubricant, adhesive, and as an industrial coating. The rule would prohibit the use of PIP (3:1) except in specified circumstances. NEII joined with other industries in the U.S. manufacturing sector urging EPA to grant more time to assess the effect of the rule on supply chains and to provide additional transition time.

On September 3, 2021, EPA announced an interim final rule extending the compliance date for PIP (3:1) to March 8, 2022, a full year beyond the original compliance date. The agency intends to conduct two follow-on rulemakings. First, EPA will develop a proposed rule establishing requirements to support any additional extensions for PIP (3:1) beyond the revised compliance date. Second, EPA will conduct a rulemaking in 2023 to re-evaluate the mandates for all five PBT chemicals and will request manufacturers and other concerned entities to provide further information on uses and substitutes for those chemicals as well as any changes needed to industry supply chains.

Oklahoma Uniform Building Code Commission Notice of Final Rules


The Oklahoma Uniform Building Code Commission adopted amendments to incorporate the 2018 IBC and other I-Codes into the Oklahoma Administrative Code. The amendments concerning the 2018 IBC include errata published by the ICC through July 31, 2019, and state-specific amendments. Chapter 30 is reserved. Final rules went into effect on September 14, 2021.

Utah Labor Commission Safety Codes for Elevators Final Rule

The Utah Labor Commission adopted by reference the 2019 edition of ASME A17.1 with the exception of Section 2.27.1. The amendments provide that the requirements listed in Section 2.27.1 will be those listed in the 2016 edition of ASME A17.1 Section 2.27.1 and not those listed in the 2019 edition.

Code Development Update

ASME A17 Code week will be held virtually the week of October 4 with several working committees and the A17 Standards committee holding meetings.  The committees will be working on changes for the 2025 edition. ASME will be issuing Public Review Drafts for proposed changes to the 2022 edition of ASME A17.1/CSA B44.

The International Building Code Public Comment Hearings were held September 21-28, 2021 in Pittsburgh. NEII provided testimony on Group A proposals related to elevators and escalators. Proposals for Group B which includes the International Energy Conservation Code and the International Existing Building Code are due by January 10, 2022.

NYC DOB Commissioner Announces Results of Department’s Citywide “Zero Tolerance” Construction Safety Enforcement Campaign

On September 13th, 2021, New York City Buildings Commissioner Melanie E. La Rocca announced the results of the Department of Building’s (DOB) citywide “Zero Tolerance” construction safety enforcement campaign, which included Department inspectors sweeping construction sites across the City to ensure that proper safeguards were in place to prevent worker falls and other related construction site injuries. Since launching the campaign on June 1st, 2021, DOB inspectors conducted approximately 7,500 sweeps at building construction work sites, issued over 3,600 violations to contractors and site safety professionals for their failure to keep work sites safe, and issued 1,499 Stop Work Orders at construction work sites. The DOB reported seven building construction-related fatalities in New York City since January 1, 2021.

The 2021 International Elevator & Escalator Symposium (IEES) will be held in Amsterdam December 6-7, 2021. This world-class, annual event brings together a global roster of top experts who present scholarly papers on the most important vertical transportation issues of the day. IEES is jointly presented by two fully independent, well-known organizations, Liftinstituut, B.V., and Elevator World, Inc.

Recent Code Adoptions

  • Utah adopted ASME A17.1-2019/CSA B44:19 effective September 8, 2021, with a deviation to Requirement 2.27.1 to use the 2016 language instead of the 2019 language.
  • Washington state adopted amendments to the elevator safety rules and fees effective October 1, 2021.
  • Delaware adopted updated rules with amendments related to fire safety (including NFPA 72 and NFPA 101) effective September 1, 2021.
