Looking Ahead to 2023

The January edition of Elevator World included NEII’s recap of 2022 and a look ahead on the goals we will continue to advance in 2023. As always, safety is the top focus and foundation for all of NEII’s efforts, and our organization has embraced a holistic and collaborative approach to supporting safety across all of our departments.
Now a month into 2023, our team plans to keep building on that the momentum from 2022, continue to collaborate with our industry partners, and learn and grow to meet the challenges and opportunities that arise. OSHA Civil Penalty Update

The U.S. Department of Labor announced changes to Occupational Safety and Health Administration civil penalty amounts based on cost-of-living adjustments for 2023.


OSHA's maximum penalties for serious and other-than-serious violations will increase from $14,502 per violation to $15,625 per violation. The maximum penalty for willful or repeated violations will increase from $145,027 per violation to $156,259 per violation.

OSHA 300 Log Submissions Due March 2

OSHA published a proposed rule, Improve Tracking of Workplace Injuries and Illnesses, on March 30, 2022 that would require:

  • Establishments with 20 or more employees, in certain high-hazard industries, continue to electronically submit Form 300A Annual Summary information once a year to OSHA.
  • Establishments with 100 or more employees in the highest-hazard industries to submit Form 300 Log and Form 301 Incident Report information once a year to OSHA. These establishments would continue to be required to electronically submit information from their Form 300A Annual Summary.

TSSA Upgrade Announcement

The third phase of the Toronto Standards and Safety Authority’s (TSSA) upgrade to an IT solution known as OASIS, covering elevating device customers and set to go live on March 1, is expected to affect service and response times for two weeks in February. All programs are scheduled to transition to the new system starting the end of the day on February 15 through February 28. Customers of all safety programs, including elevating devices, who plan to submit requests or applications are urged to so before February 15 or after February 28.

As a result of the migration, which aims to modernize and simplify services, TSSA has extended the expiration date for all active elevating devices contractor registrations from March 31, 2023, to May 31, 2023. Further detail may be found in the TSSA announcement

Code Development Update

ASME A17/CSA B44 Safety Code for Elevators and Escalators: ASME A17/CSA B44: ASME has received final ANSI approval for the 2022 edition of A17.1/B44; however, publication is not expected until Q2 of this year. The effective date will be 6 months from the publication date. There were approximately 110 records approved for this cycle, some impacting multiple requirements.  Updates include requirements for new technologies including cybersecurity, personnel safety, and several updates for maintenance, inspection, and testing. All of the working committees are now focused on changes for the 2025 edition.

ICC International Building Code Series (I-Codes):
All changes for 2024 I-Codes are now complete and publication is expected sometime this year. The window to submit changes for the next cycle will open later this year.

ICC A117.1 Standard for Accessible and Usable Buildings and Facilities: The A117 committee is meeting virtually every two weeks to review proposed revisions for the next cycle.  The goal is to complete the work in time for publication at the end of 2023.

NFPA 70 National Electric Code – Changes for the 2023 edition have been completed and the new edition is now available from NFPA. NFPA is now accepting proposals for changes for the 2026 edition until September 7, 2023.

NFPA 101 Life Safety Code and NFPA 5000 Building Construction and Safety Code All the changes for the 2024 editions have been completed.  Publication of the 2024 editions is expected in 2023.  The window to submit changes for the next cycle will open later this year or early next year.
Key Recent Code Adoptions

  • Arizona – Adopted 2019 edition of ASME A17.1/CSA B44.  Effective 60 days after publication in the Arizona Register.
  • North Dakota – Adopted 2021 I-Codes effective 1/1/2023.
  • Washington – Adopted 2021 I-Codes effective 7/1/2023.
